Letter to Fight the eviction notice
Dear Uncle Ala (Sam Au Hoy),
We are writing to formally respond to the eviction notice we recently received. This letter is to express our opposition to the eviction and to make clear our intent to challenge it through legal channels if necessary.
Firstly, it is important to point out that the residence in question previously belonged to our grandmother, and my family, specifically Noah Alesna and Robin Alesna, has been living in this home for years. During this time, we have not been required to pay rent, as we have maintained the property by taking care of the yard and providing necessary maintenance. At no point prior to your appointment as Power of Attorney was there any indication that rent was required.
To date, no formal notice or communication has been issued by you or anyone else indicating that rent needed to be paid once you assumed Power of Attorney. Therefore, issuing an eviction notice under these circumstances lacks any legal grounds and contradicts the established living arrangements.
In addition to these facts, we have made numerous attempts to reach out to you in good faith to come to an agreement regarding the purchase of the home to keep it in our family. Unfortunately, you have remained unresponsive, which not only demonstrates a clear disregard for the preservation of family ties but also a failure in your duty as Power of Attorney to reasonably consider options that would maintain the home's connection to its family of origin.
After consulting with legal counsel, we have been informed that, as Power of Attorney, you have certain legal obligations to act in the best interest of the family and consider reasonable offers to retain ownership of the property within the family. Your continued unresponsiveness and decision to issue an eviction notice without exploring these options are troubling and legally questionable.
We want to make it absolutely clear that we do not intend to vacate our home easily. We are prepared to fight this eviction in court, if necessary, to protect our rights and our family’s connection to this property.
We urge you to reconsider your position and withdraw the eviction notice so that we can discuss a fair and reasonable solution that benefits both parties. We are still willing to work toward an agreement for purchasing the home, but we will not hesitate to take legal action if you continue to disregard our rights and the history of this property.
